These regulations do not only refer to traditional smoking, but often also include the vaporization of plant material such as cannabis flowers. Even if you are carrying cannabis exclusively for your own use, a club can prohibit consumption at any time, and you are not entitled to an exemption.

 

Why does house policy decide?

Even though there is no nationwide ban on vaporizers, club and bar operators always have the right to enforce their own rules. Every operator can set their own rules and thus determine whether the vaporization of cannabis or CBD products is permitted on their premises. This means that you may be able to vape in one bar without any problems, while the next location expressly prohibits it. In places such as train stations, airports, or on public transportation, the same rules often apply as for traditional cigarettes. In these places, vaping is usually only permitted in specially designated smoking areas or is even completely prohibited.

 

 

What are the obligations of event organizers and what are the risks involved?

Operators of clubs and bars are obliged to comply with both the Non-Smoker Protection Act and the Youth Protection Act. They can therefore restrict or prohibit the use of vaporizers at any time if they deem it necessary. They must also ensure that minors do not have access to cannabis or nicotine-containing products. Anyone who violates these regulations risks being expelled and may be banned from the premises. Event organizers face heavy fines for disregarding youth protection laws. Strict labeling and age verification requirements also apply to the sale of vaporizer products or CBD items, meaning that shops and clubs are obliged to carefully check the age of their guests.

 

What does the Youth Protection Act stipulate?

The Youth Protection Act makes no distinction between traditional e-cigarettes, CBD products, or devices for vaporizing cannabis. For young people and children, this means that neither the possession nor the consumption of products containing nicotine or cannabinoids is permitted. Operators of clubs, bars, and other venues must therefore check the age of their guests, similar to when serving alcohol. In Germany, minors are therefore not allowed to vape CBD or cannabis – regardless of whether they are using a private vaporizer or a vape pen purchased on site.
